Arise Family maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Arise Family. If you do not agree to these terms, do not use this Site.

 

1. Use of Site

Arise Family provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Arise Family authorizes each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials without the consent of Arise Family and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them unless the copyright of the Materials allows such use. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity without the consent of Arise Family. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

You do not obtain any trademark, copyright, database or any other intellectual property right of any nature or licence by using the Website. You are not granted any license or right to use any trademark without the organization’s prior written permission and/or that of any third party.

Arise Family has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. The Website contains confidential information, which is the property of Arise Family and its data subjects.  Consent has been given to share certain confidential information on the website. Unauthorised disclosure and/or use of this information may incur civil or criminal liability.

 

Any of your personal information available on the Website and which you supply to the organization when using the Website will be used by the practice in accordance with its Privacy Policy, POPIA Policy and subject to legislation.

 

All information that you provide to us may be stored electronically and with third parties, which parties are bound by strict levels of confidentiality. The organization takes all reasonable steps to protect your personal information and maintain confidentiality, including by making use of encryption technology. However, the organization cannot guarantee the security or integrity of any information you transmit to it online and you agree that you do so at your own risk.

6. Limitation of Liability

In no event will Arise Family, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from lower test scores, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

 

7. Cancellation and Refunds

If you are not satisfied with the digital product or e-course for any reason you can get a refund within 7 days of making a purchase.  We would ask that you kindly delete all copies of the downloads or digital products if you do request a refund.  Requesting a refund will also mean you lose access to the course platform and any future updates to the material in the course of downloads.  If you request a refund and any physical product was shipped to you as part of the course, you will be required to ship the items in their original packaging and unused back to Arise Family before your refund will be arranged.  Any transaction fees associated with processing your credit card and the refund will be deducted from the amount of the course we refund to you.  

 

You will have access to the course or digital product and any updates made for the life time of the course or product on our site, unless expressly stated in the description and conditions of the course. Arise Family reserves the right to cancel, remove or retire a course should they choose to do so.  All participants will be given a minimum of 3 month’s notice of such removal or retirement. If Arise chooses to retire or remove a course from our platform, those who have previously enrolled in the course and who continue to have access will be given 14 days to download materials from the platform before it is permanently removed.

 

8. Applicable Law

The Terms of Use are governed by the laws of the Republic of South Africa. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Arise Family may assign its rights and duties under the Terms of Use without notice to any party at any time.

 

9. Effective Date and Updates

The Terms are effective as of 1 August 2021 and are subject to change without notice by Arise Family. at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
